MediaBreaker is a video editor which enables you to remix – or break – a variety of media, such as commercials, news clips, music videos and more. We highly suggest you create an account at MediaBreaker/Studios so you can save your work.

We also highly recommend you watch the videos on the left. They’re short, but will help you make breaks we can actually publish. You can also check out the MediaBreaker YouTube channel for examples of fair use broken videos. We hope to see yours there soon!

Introduction to the MediaBreaker

1. The Purpose of the MediaBreaker

a. The MediaBreaker is a tool for creating constructive commentary on media. Please use it accordingly.

b. The MediaBreaker is not intended for people under the age of 13, so if you’re less than 13 years old, you should not be using the MediaBreaker.

2. Our Process

a. The goal of our service is to create a safe and easy to use avenue for public commentary on media that teaches people how to use their fair use rights.
b. We have a short video that explains the basics of fair use law. You need to watch this before you use the MediaBreaker – it will help you create videos that will actually get posted. Plus it’s less than two minutes long.
c. If we think that your video is not a fair use, we will do our best to let you know what should be changed and give you a chance to correct and resubmit the video.
d. Once a video is posted to the MediaBreaker, you will not be able to make any further changes to it.
e. We will not post anything that we consider indecent, inappropriate, hateful, or dangerous. Please use the MediaBreaker nicely.
f. We can take down any video at any time for any reason.

3. Your Use of the MediaBreaker

a. Anything you create on the MediaBreaker belongs to you, but by submitting a video, you grant The LAMP a license to use your video and all associated copyrights in whatever way the LAMP wishes.
b. Please respect the LAMP’s website, including its code, Intellectual Property, and information about users, by not stealing, hacking or otherwise damaging the contents of the website.
c. The LAMP will not sell your information to anyone else and will do our best to protect your privacy.
d. The LAMP is not responsible for anything outside of our own websites, so navigate the internet with caution!
e. Before submitting any videos to the MediaBreaker, you will be required to read the MediaBreaker’s official Terms of Service (below).

MediaBreaker Terms of Service

This agreement (“Agreement”) between yourself and The Learning About Multimedia Project, Inc. (“The LAMP”) governs your conduct and the parties’ respective rights with respect to any submissions you make associated with the MediaBreaker interactive tool (“MediaBreaker”). For the purposes of this agreement:

You agree that you shall not upload any Submission that includes or references any one or more of the following:

The LAMP shall have the right, by its sole discretion, to pursue any actions with regard to your Submissions through the MediaBreaker, including but not limited to:

Grant of Rights and Release

In exchange for using the MediaBreaker and having your Submission(s) considered for use by The LAMP and/or as otherwise detailed below, you grant the LAMP a non-exclusive, worldwide, perpetual, irrevocable, fully paid-up, royalty-free, fully sublicenseable and transferable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, transmit, display, and perform such Submission(s), in whole or in part, in any media, format or technology, whether now known or hereafter discovered, and in any manner including, but not limited to, all promotional, advertising, marketing, publicity, and commercial uses and ancillary uses thereof, without any further notice or payment to or permission needed from you (except where prohibited by law).

You also agree to waive any applicable moral rights as contained in your Submission(s) for any of the proposed uses listed above. Without limiting the foregoing, submission of a Submission constitutes your agreement that The LAMP is permitted to display the Submission online for public viewing and/or commentary (whether on The LAMP’s web pages or on third party web pages), and to reproduce, adapt and distribute the Submission in all media, whether now known or later developed. However, The LAMP will have no obligation to post or use any Submission(s).

You understand that The LAMP is relying upon your representations, grants of rights, waivers and releases in permitting you to submit a Submission. You acknowledge that you may not terminate or rescind the grants of rights and licenses and/or the releases contained in this Agreement.

Warranty Disclaimer

You agree that your use of the MediaBreaker shall be at your sole risk. To the fullest extent permitted by law, The LAMP, its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the MediaBreaker and your use thereof.

The LAMP makes no warranties or representations about the accuracy or completeness of the MediaBreaker’s content or the content of any sites linked to by the MediaBreaker and assumes no liability or responsibility for any and all:

Limitation of Liability

In no event shall The LAMP, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any and all:

As with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.

Choice of Law, Venue and Jurisdiction

This Agreement shall be governed by and interpreted in all respects in accordance with the substantive laws of the State of New York. You agree that any disputes directly or indirectly arising out of or relating to this Agreement shall be resolved exclusively in the federal courts located in the Southern District of New York. You hereby irrevocably consent to such venue and to the exclusive jurisdiction of any such court over any such dispute. If any provision of this Agreement is determined to be invalid by a court of competent jurisdiction, such determination shall in no way affect the validity or enforceability of any other provision.

This Agreement sets forth the entire agreement of the parties with respect to your Submission(s) and may not be changed except by an instrument in writing signed by both parties. This Agreement supersedes any and all prior agreements between the parties.
